Hate Crimes Plan of Attack

As many of you are already aware, we are currently in the initial planning stages of prosecuting Scientology for hate crimes (promoting hate-filled literature and company policy) via a massive dissemination campaign and working in conjunction with the government and various civil rights / activist groups.

Current editions of Dianetics and Science of Survival both have material that may have been ignorantly acceptable in the 1950's when they were written, but in the context of this day and age, considering the current laws in place in Canada, the literature itself is technically illegal.

In section 318 of the criminal code (C-46) an identifiable group subject to hate is defined as "...any section of the public distinguished by colour, race, religion, ethnic origin or sexual orientation."

The Criminal Code clearly states that any person or organisation willfully promoting or communicating hatred, other than in a private conversation, is committing a criminal offense. This is clearly what the CoS is doing by promoting, selling and distributing the two books in question, one of which (Dianetics) is clearly visible from the sidewalk while walking by the org.

The criminal code, however, turns a blind eye to (and defends) religions and religious texts. It states that no person shall be convicted of an offence "if, in good faith, the person expressed or attempted to establish by an argument an opinion on a religious subject or an opinion based on a belief in a religious text".

This will be the more difficult part to prove. At first pass, most groups will dismiss the contents of these books as being under the protection of religious text. However, there are a number of issues one can raise to dispute this point: first, the Church of Scientology is the entity selling these books and is considered a business to the federal government, not a 'Church' or religious establishment; second, the books in question touch on 'spiritual' issues, but are not considered religious doctrine in the traditional sense (Scientology can be practised without the literature; a Scientologist can be instructed verbally on the applied therapies contained in Dianetics and audited with an e-meter without any prior knowledge of Dianetics. In fact, Free Zone Scientologists often create their own literature based loosely on Dianetics because of legal issues stemming from the unauthorised use of the text); L. Ron Hubbard himself characterised Dianetics as a self-help book until the mid 1950's when he created Scientology as a vehicle for propagating his books and emphasising the 'spiritual' aspect of the book as opposed to the predominately pseudo-science content of the book. One does not arbitrarily absorb hate literature into a religion.

Another point is that the staff members at all orgs attempt to sell Dianetics on the street, at fairs and various public events by handing out flyers/cards and other advertising media, but specifically do NOT mention its connection to Scientology anywhere on the media or in conversation. The content is never explicitly labeled or promoted as religious scripture or even being associated with a religion. This leads to the conclusion that Scientologists themselves do not consider the texts to be religious or integrated into the core of their religion, which thereby should omit them from the religious protections noted in the Criminal Code. At the very least, anybody selling the book should be lawfully obligated to note the connection to the Church of Scientology and a warning should accompany every copy of these books sold in Canada, stating that the opinions in the book are subject to religious protection and may offend readers not of the same religion or opinion.

When many think of Scientology, they see Tom Cruise jumping on sofas and parodies on South Park. The grim reality is that Scientology is a destructive and criminally convicted hate group in Canada with a well-documented history of Human Rights abuses. Despite their claims, Scientology is not a recognized religion or charity in Canada. The organization merely holds a “religious non-profit” status.

Scientology actually believes and promotes that Homosexuality is a mental and physical illness that they can "cure". They continually claim that these anti-gay beliefs are scientific and not religious in nature. They do this through two different books, one called "Dianetics: The Modern Science of Mental Health" and the other called "Science of Survival".

This is the quote from Dianetics:

"The sexual pervert (and by this term Dianetics, to be brief, includes any and all forms of deviation in dynamic two [sexuality and procreation] such as homosexuality, lesbianism, sexual sadism, etc., and all down the catalog of Ellis and Krafft-Ebing) is actually quite ill physically." –DMSMH, Book 2, Chapter 5

In the sequel to Dianetics called "Science of Survival" Scientology establishes the “Tone Scale” ranging from -3 to +4 in an attempt to classify people and their behaviour. LGBT people are classified at 1.1 or ‘covert hostility’ Hubbard recommends a extremely disturbing solution for people below 2.0:

“The first is to raise them on the tone scale by un-enturbulating some of their theta by any one of the three valid processes. The other is to dispose of them quietly and without sorrow.” –Science of Survival 50th Anniversary Edition

These books written in the 1950s by science fiction author L. Ron Hubbard are still considered relevant and truthful by Scientologists today. Critical thinking, questioning, or not believing anything that Hubbard wrote is strictly forbidden and leads to serious consequences and punishment. If a member does not do/believe what Scientology tells them to, then it's a problem with the person that needs to be 'fixed' and not Scientology. This is still only one small aspect of Scientology's abuses and crimes.
